Terms of Service

These Terms of Service (“Terms”) govern your use of babecock.app (the “Site”), operated by BabeCock Maker (“we”, “us”, “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Age Requirement

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to access or use this Site.

This Site contains sexually explicit material. By using the Site, you represent and warrant that:

• You are at least 18 years old
• Viewing sexually explicit material is legal in your jurisdiction
• You are accessing the Site voluntarily

We reserve the right to terminate any account we reasonably believe belongs to a minor.

2. Account Responsibilities

When you create an account, you agree to:

• Provide accurate information (username and email)
• Keep your login credentials secure and not share them
• Accept responsibility for all activity under your account
• Notify us immediately if you suspect unauthorized access

We reserve the right to suspend or delete accounts that violate these Terms.

3. User-Generated Content (UGC)

3.1 Your Uploads

You may upload images for use in your own personal rotations. Your uploads are private to your account and are never shared with other users or included in any public pool. By uploading, you represent and warrant that:

• You own the content or have the necessary rights and licenses to upload it
• All individuals depicted are at least 18 years old and have consented to the content
• The content does not violate any applicable law
• The content does not infringe on any third party’s intellectual property, privacy, or other rights

3.2 License Grant

By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to store and display the content to you as part of the Site’s functionality (personal image rotations). If you choose to share a creation, the resulting snapshot and/or video may appear in the public gallery. You retain ownership of your original content.

This license ends when you delete the content from the Site.

3.3 Shared Creations

When you share a creation (snapshot or video), it receives a public URL and may appear in the Site’s gallery. You can make shared creations private or delete them at any time from your profile.

4. Prohibited Content & Conduct

You agree not to upload, share, or use the Site to distribute:

• Content depicting minors in any context (zero tolerance)
• Non-consensual content (revenge porn, hidden camera, etc.)
• Content depicting real violence, coercion, or abuse
• Content that violates any applicable law (bestiality, etc.)
• Malware, viruses, or other harmful files
• Spam, advertising, or commercial solicitations

You also agree not to:

• Attempt to access other users’ accounts
• Circumvent rate limits, security measures, or access controls
• Scrape, crawl, or bulk-download content from the Site
• Use automated tools (bots) to interact with the Site without permission
• Interfere with the Site’s operation or other users’ experience

We reserve the right to remove any content and suspend any account that violates these rules, without prior notice.

5. DMCA & Copyright Takedown

We respect intellectual property rights. If you believe content on the Site infringes your copyright, send a takedown notice to:

Your notice must include:

1. Identification of the copyrighted work you claim is infringed
2. Identification of the infringing content on the Site (URL or description)
3. Your contact information (name, email, mailing address)
4. A statement that you have a good-faith belief the use is not authorized
5. A statement, under penalty of perjury, that the information is accurate and you are the copyright owner or authorized to act on their behalf
6. Your physical or electronic signature

Upon receiving a valid DMCA notice, we will:

• Promptly remove or disable access to the reported content
• Notify the uploader (if identifiable) of the takedown
• Process any valid counter-notification per applicable law

Repeat infringers will have their accounts terminated.

6. Intellectual Property

The Site’s design, code, logo, and non-user-generated content are owned by BabeCock Maker and protected by applicable intellectual property laws. You may not copy, modify, or redistribute any part of the Site without our written permission.

7. Disclaimer of Warranties

The Site is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The Site will be uninterrupted, secure, or error-free
• Uploaded content will be preserved indefinitely (back up your own files)
• The Site will be available in all jurisdictions

8. Limitation of Liability

To the maximum extent permitted by law, BabeCock Maker shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use the Site
• Any content uploaded or shared by users
• Unauthorized access to your account or data
• Loss of data, including uploaded images or shared creations

Our total liability for any claim related to the Site shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless BabeCock Maker from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Site
• Content you upload or share
• Your violation of these Terms
• Your violation of any third party’s rights

10. Termination

We may suspend or terminate your access to the Site at any time, with or without cause, with or without notice. Upon termination:

• Your license to use the Site is immediately revoked
• We may delete your account, uploads, and shared creations
• Provisions that by their nature should survive (liability, indemnification, dispute resolution) will remain in effect

You may delete your account at any time by contacting us.

11. Governing Law & Disputes

These Terms are governed by the laws of the Czech Republic. Any disputes arising from these Terms or your use of the Site shall be resolved in the courts of the Czech Republic.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last Updated” date. Continued use of the Site after changes constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.
